Why do you need a process server?

A process server or sheriff are authorized in Texas to serve service of process on behalf of your suit/case. The judge over your case may order you to hire a process server to serve your documents. Process Servers can serve a variety of documents including subpoenas, petitions, citations, summons, and some writs.  

Process Servers are not PI'S we can not locate someone for you, but we can assist with locating  an address and offer stakeout services for difficult defendants. 



TEXAS RULES AND PROCEDURE

You cannot serve someone on a Sunday in Texas nor if the defendant is coming out of court mediation. It is illegal! However, if your case is filed out of state, we can serve process by that's state's rules and procedures. 

What to do if you've been served

If you have been served court papers or documents, whether it is a citation, summons, or subpoena, you the defendant usually as 20 to 30 days to respond. The exact amount of days your have to respond, court date, court info, case info., or anything else should be on the front or second page of the citation, summons, or subpoena. 

It is not a good idea to ignore legal documents you have been served with. Not responding to a court document can result in a default judgement being granted or can lead to legal consequences.

Let's do a stakeout! For defendants who are evading service, a stakeout may be needed to serve he or she with your legal documents. This may be the only way to serve them. Our hourly rate is $75 an hour. Stakeout length vary case by case. Contact us to discuss your case.

HOW TO SERVE SOMEONE CHILD CUSTODY PAPERS IN TEXAS

LEARN HOW TO SERVE YOUR CUSTODY PAPERS 

Once you file your child custody or paternity case, you need to ensure that the other parent is "served" with the paperwork. This is formally called "Service of Process." It is the plaintiff's or your responsibility to ensure that the other parent is given notice or due process of the proceedings.

The papers are not served on you by the court. You must make sure the other parent is served if you don't, your case will be dismissed, and you'll have to start over from scratch. 

THE BEST WAY TO SERVE YOUR CHILD'S PARENT IS  TO HIRE A PRIVATE PROCESS SERVER. A PROCESS SERVER IS AN INDIVIDUAL THAT IS REGISTERED AND CERTIFIED BY YOUR STATE TO LEGALLY AND PROPERLY SERVE SERVICE OF PROCESS. 

  • STEP ONE. WHAT ARE YOU SERVING THE DEFENDANT? ALL FORMS THAT WERE FILED WITH THE COURT. MAKE SURE YOU GIVE ALL OF THE DOCUMETNS TO THE PROCESS SERVER SO THEY CAN SERVE THE DEFENDANT WITH ALL OF THE PAPERWORK. 

  • STEP TWO. WHEN DO I SERVE THE DEFENDANT? AS SOON AS POSSIBLE. IF YOU DONT GET THE PAPERWORK SERVED TO THE DEFENDANT BY THE COURT DATE, THEN YOUR CASE CAN BE DISMISSED. KEEP IN MIND THAT SOME PROCESS SERVERS OFFER RUSH SERVICE FOR AN EXTRA FEE IF YOU ARE ON A STRICT DEADLINE.  WE CHARGE AN ADDITONAL $40 FOR THIS SERVICE.

  • STEP THREE. WHO CAN SERVE THE DEFENDANT?  A STATE PROCESS SERVER OR SHERIFF.

  • STEP FOUR. HOW TO SERVE THE DEFENDANT?  A DEFENDANT USUALLY HAS TO BE SERVED IN PERSON FIRST. BEFORE REACHING OUT TO A PROCESS SERVER, TRY TO HAVE AS MANY DETAILS AS POSSIBLE. SOME DEFENDANTS MAY "EVADE SERVICE" SO YOUR PROCESS SERVER WILL NEED AS MUCH INFORMATION AS POSSIBLE SUCH AS PHYSICAL ATTRIBUTES, PHOTOS, WORK SCHEDULE, A LITTLE BACKGROUND ON THE CASE AND SO ON. THE ACTUAL PROCESS OF THE SERVICE ATTMEPTS IS LEFT TO THE DISCRETION OF THE PROCESS SERVER.

  • STEP Five. WHAT HAPPENS IF THE DEFENDAnT CANNOT BE SERVED? IF DUE DILLEGENCE HAS BEEN SHOWN (USUALLY THREE SERVICE ATTEMPTS) THAT YOU HAVE TRIED TO SERVE THE DEFENDANT IN PERSON, THEN YOU CAN FILE FOR ALTERNATIVE OR SUBSTITUTE SERVCE . THE JUDGE WILL USUALLY APPROVE FOR THE DEFENDANT TO BE SERVED BY MAIL, AFFIXING THE DOCUMENTS THE FRONT DOOR OF THE RESIDENCE, OR SERVING A SPOUSE.
